By this petition, the petitioner seeks a direction to the Police attached to Wadala Truck Terminal Police station to register an FIR on the basis of the petitioner's complaint. 1/3

Learned A.P.P, on instructions, states that the police have filed the petitioner's complaint, as the petitioner did not come forward to record his statement. He states that the said decision is communicated to the petitioner vide letter dated 28th August 2024.

Learned counsel for the petitioner disputes the same. He submits that on several occasions, the petitioner went to the Police Station, however, the police did not record his statement. Be that as it may, learned A.P.P, on instructions, states that the police will re-open the petitioner's complaint, since it was not considered on merits. He further states that the petitioner's statement will be recorded by the police within two weeks from today, after which, the police will take appropriate steps in accordance with law, on the basis of the petitioner's complaint, uninfluenced by the closure of the complaint. Statement accepted.

Learned counsel for the petitioner also assures that the petitioner will remain present before the concerned Officer for recording his statement. Statement accepted. In view of the aforesaid, nothing survives for further consideration in the petition. Petition is disposed of. Needless to state, that if the petitioner's statement discloses the commission of a cognizable offence, the police to take steps in accordance with law.
