The learned Senior Advocates, as well as the learned Advocates for the appearing parties, have strived and used their

good offices to arrive at an amicable decision. The consent terms dated 8th May, 2025 (four pages) have been reduced in to writing. The Advocates for the parties as well as the parties themselves, who are present in the Court, have signed on the consent terms. The said consent terms with the original signatures of the learned Advocates and the parties, are taken on record and marked as 'X-1' for identification. The statements made by the parties in the consent terms, X-1, are taken to be statements made to the Court. 2.

Mr.Patil, the learned Advocate for the Original Complainant/ Respondent No.2, has tendered an original affidavit dated 8th May, 2025 (three pages), sworn and affirmed by the Complainant, namely, Shri Sachin Shantaram Dahibavkar,. The said original affidavit is taken on record and marked as ' X-2' for identification. He submits that this affidavit is to indicate that the Petitioners agree with the consent terms.

By the consent of the parties and in the light of the above, Writ Petition No. 2265 of 2025 is partly allowed in terms of prayer clause (a), which reads as under:

"a. The Hon'ble Court be pleased to quash and set

aside the entire proceedings in Special Case No. 17 of 2025 filed u/s. 188, 506 r/w 34 of IPC and Sections 3 (1)(p), 3(1)(q), 3(1)(u), 3(1)(r) and 3

(2) (va) of The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and pending before the Ld. Special Court, Sindhudurg, Oros, arising of FIR No. 0016 of 2025 registered with the Devgad Police Station". 4.

Writ Petition No. 2269 of 2025 is allowed and accordingly disposed off in terms of prayer clause (a) set out in Writ Petition No. 2265 of 2025.
