C. :- 1) After hearing the aforesaid Petitions for some time, the learned Counsel for the Petitioner state that he will file an application before the trial Court with a prayer to direct the Respondent No.1 CBI to provide the list of the documents seized/collected during investigation, but not relied on by it for the sake of the prosecution. 2) The learned Counsel for Respondent No.1 states that, if such an Application is filed by the Petitioner, the Respondent No.1 - CBI will supply the list as referred above. He further states that, on providing such list, the Petitioner will be at liberty to file a fresh Application under Section 1/2
P.H. Jayani 907 WP2521.2025.doc 91 of Cr.P.C./corresponding Section 94 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 in view of the Apex Court judgment in the case of re, v/s. State of Andhra Pradesh and Ors. in Suo Moto Writ Petition (Cri.) No. 01 of 2017.
3) The learned Counsel for the Petitioner agreeable to the said suggestion by Mr. Munde, and on instructions, seeks to not press the Petitions with the aforesaid liberty.
