This matter was heard for some time.

We have perused the order passed by the Division Bench of this Court dated 21st July, 2025 in Writ Petition No.2939/2024, filed by the present Petitioner, more particularly, paragraph No.7 of the said Order which reads as under:

For the aforementioned reasons, we find that the Petitioner did not qualify the essential eligibility criteria laid down in the notice inviting tender and therefore, his bid has rightly been rejected. However, it will be open for the Petitioner to make a complaint with regard to genuineness or otherwise of the certificates annexed by Respondent No.3 along with their bid documents. In case, any such complaint is filed, the Corporation shall consider the same after affording opportunity to the parties and shall pass appropriate orders thereon. It is made clear that this Court has not expressed any opinion on merits of the matter. 3.

The learned Advocate for the Petitioner submits that his complaint as regards the forged documents, was already lodged with the Corporation and the Corporation is not dealing with the same. 4.

On instructions, the learned Advocate submits that the Petitioner would again move the Civil Division Bench of this Court for seeking a direction to the Corporation, to decide the complaint in the light of the observations of this Court in paragraph No.7, of the Order dated 21st July, 2025. In view of the above, leave to withdraw the Writ Petition is granted. 5.
