Heard the learned Counsel for the Petitioner. 2.
The challenge in this Petition is to an order dated 1 February 2016 by which charge against the Petitioner for the offences punishable under Sections 342, 343, 348 of the Indian Penal Code, 1860 and Section 147(c) and (d) of the Maharashtra Police Act, 1951 was framed. 3.
Charge was framed on 1 February 2016. Thus, the instant Petition, which is filed after 9 years of the framing of the charge, does not deserve to be entertained on account of delay and laches. 4.
Learned Counsel for the Petitioner submitted that the trial in CC 115/PW/2016 has made no progress. No witness has been examined till date. The Petitioner is 72 years of age and on account of the instant prosecution, the Petitioner is getting diminished pension. SSP 1/2

The circumstances pointed out by the learned Counsel for the Petitioner make out a case for expeditious hearing and conclusion of the trial in CC 115/PW/2016.

The Writ Petition stands disposed with a request to the learned Metropolitan Magistrate, 37th Court, Esplanade, Mumbai, to commence and conclude the trial in CC 115/PW/2016 as expeditiously as possible, and, preferably, within a period of nine months from the date of communication of this order.
