It is apparent that the order dated 5th May, 2025 has not been followed by the Petitioner. He only enjoyed the benefit of the order without discharging the obligation of complying with it. 2.
We have considered the submissions of the learned 1/3
Advocate for the Petitioner, who submits on instructions that since the order dated 12th November, 2024 passed by the learned Judicial Magistrate First Class (JMFC) 30th Court, Kurla with a covering letter dated 23rd November, 2024 was with reference to the Interim Compensation under Section 143-A of the Negotiable Instruments Act 1981, that the Petitioner would now deposit a total amount of Rs.11,00,000/- and the said order may be vacated. 3.
The learned Advocate representing Respondent No.2 submits that if the amount of Rs.11,00,000/- is deposited before the Trial Court, he has no objection if the order dated 12th November, 2024 passed by the learned JMFC with a covering letter dated 23rd November, 2024, is said to have been fructified. 4.
The learned Advocate for the Petitioner submits that an amount of Rs.10,00,000/- would be deposited with the learned Magistrate by tomorrow and the remaining amount of Rs.1,00,000/- would be deposited by Friday i.e. 1st August, 2025. 5.
In view of above, this Petition is disposed off by recording the aforesaid statements of the Petitioner. Needless to 2/3
state, that the learned Magistrate would permit the Petitioner to deposit Rs.10,00,000/- by 31st July, 2025 and the remaining amount of Rs.1,00,000/- will be deposited by the Petitioner with the said Court, by 1st August, 2025.

If the entire amount of Rs.11,00,000/- is deposited, the order dated 12th November, 2024 passed by the learned JMFC with the covering letter / instructions dated 23rd November, 2024 would lose their efficacy.
