P.C.:- 1) It is the contention of Petitioner that the suicide note mentioned in Paragraph No.3 of the First Information Report (FIR) does not form part of the charge-sheet and in the absence of suicide note, only on the basis of a bald statement in FIR, Section 32 of the Evidence Act cannot be attracted to the present crime.

2) We therefore direct the Superintendent of Police, Sangli to file his detailed reply to the Petition. The Superintendent of Police, Sangli shall not delegate his powers to any sub-ordinate officers while filing the reply. We further direct the Superintendent of Police, Sangli to peruse the entire record minutely and in its reply place the correct facts on record regarding non-annexure of the suicide note of the deceased which was discovered on 31st December, 2023 by the first informant Mr. Vijaykumar H. Kamble. 1/2
