1) In pursuance of Order dated 20th June, 2025, Shri.Mahesh Chimate, DCP, Mumbai Zone - 12, Dahisar (East), Mumbai has filed a detailed Affidavit dated 2nd July, 2025. The contents of the communication between Emirates Airlines and the Police Department are reproduced in KIRAN SANJAY GHUGE paragraph Nos. 9 and 13 thereof. The Emirates Airlines has categorically KIRAN SANJAY GHUGE Date: 2025.08.25 15:45:57 +0530 informed that, the 'e-tickets' are counterfeit. The Deputy Commissioner of Police after perusing entire evidence has also expressed his opinion that, the Petitioner not only cheated the complainant but also forged airlines tickets and submitted it during bail proceedings.

KSG 39-WP-2870-2025.doc 2.1) Learned APP, on instructions submitted that, the Petitioner is reported to be absconding and Look Out Circular dated 16th August, 2025, is issued against her.

3) In view of the fact that, the Petitioner is absconding and look out circular is issued against her, we are not inclined to exercise our jurisdiction under Article 226 of the Constitution of India in favour of the Petitioner. 4) The Petition is accordingly dismissed in limine.
