The learned counsel for the Petitioner, on instructions, seeks leave to withdraw the petition with liberty to assail the order impugned in this petition in a Criminal Revision Application. 3.

Leave granted with liberty as prayed for.

The time spent by the Petitioner in prosecuting this petition may be accounted for under Section 14 of the Limitation Act, in the event the question of limitation arises in filing the Criminal Revision Application.

It is clarified that this Court has not entered into the merits of the matter and the learned Sessions Judge shall decide the Criminal 1/2
