The Petitioner has put forth Prayer Clause (b), as under :- "b) This Hon'ble Court be pleased to issue, direction or order under Art 226 of the Constitution of India, and in the exercise of its inherent powers to issue a writ of Mandamus and/or any appropriate writ and/or order directing fair trial pending on the file of Learned JMFC court, 69th court, Mazgaon vide PW/792/2021 arising out of FIR vide C.R. NO.441/2021 dated 27/7/2021 registered at Sir JJ Marg police station for the offences punishable 452, 387, 509, 506(2), 323, 504, 34 of the Indian Penal Code, 1860 and also ensure that all the material witness are examined in the present case." The learned Advocate for the Petitioner submits on instructions that the Petitioner is tendering an unqualified apology. He is regretful that the prayer was drafted in a manner as is evident from the reproduced prayer clause.

By tendering an apology, the Petitioner desires to withdraw this Petition.

In view of the above, this Writ Petition is dismissed as withdrawn, on instructions. We caution the learned Advocate for the Petitioner to, henceforth, use appropriate language while drafting the Petition as well as the prayer clause.
