In this Writ Petition iled under Article 226 of the Constitution of India, the challenge is to the legality and validity of the Order dated 17th January 2025 passed by the Deputy Inspector General of Prisons, Pune, by which the Petitioner's application seeking furlough leave has been rejected.

It is the contention of Mr. Jaiswal, learned Counsel for the Petitioner, that the impugned Order has been passed on the basis of the Maharashtra Prisons (Furlough And Parole) Rules, 2024, which came into efect on 2nd December 2024.

However, Mr. Naik, learned APP, states that the Petitioner was released on furlough leave for the period from 24th December 2025 to Arjun 1 of

902-WP-2948-2025.doc 1st February 2026. He submits that the Petitioner surrendered to Prison Authorities on 2nd February 2026. He further submits that, if a fresh application for furlough leave is iled, the same will be considered in accordance with law.

Accordingly, nothing survives in the Writ Petition and the same is disposed of.
