The respondent herein has filed the application under the provisions of Protection of Women from Domestic Violence Act for various reliefs against the present petitioners. The learned counsel for the respondent, on instructions, submits that the trial Court has issued the summons against the petitioner No.1 only and not against the petitioner Nos.2 and 3.

In that view of the matter, learned counsel for the petitioners, on instructions, seeks leave to withdraw the present petition with liberty to file fresh petition, if the summons are issued against the petitioner Nos.2 and 3.

Leave granted. The Petition is disposed of as withdrawn with liberty as sought.
