CORAM

:

RAVINDRA V. GHUGE & GAUTAM A. ANKHAD, JJ.

DATE :

18th July, 2025 P.C.:- 1.

Leave is granted to delete the figure "22nd" from prayer clauses (a) and (b). Deletion be carried out forthwith. 2.

The Petitioners are Accused in Crime No. 77 of 2020 registered on 14th April, 2020 with the Kasa Police Station, Thane for the offence punishable under Sections 302, 307, 120B and 353 of the Indian Penal Code, 1860.

3.

The grievance is that the Bail Application, Exhibit 302, in Sessions Case No. 183 of 2022, filed on 18th December, 2023, is still pending without an adjudication.

1/3

4.

The learned Advocate for the Petitioners submits that though there is a heavy workload in the Sessions Court, Thane, several other Bail Applications, concerning the same crime, have already been decided and the matters have also reached the High Court. 5.

We find that the request made by the Petitioner is neither unusual nor cumbersome in nature. He merely seeks a decision on the Bail Application filed by the Petitioners.

6.

The learned Addl.PP submits that the written say of the Investigating Officer was filed on 4th April, 2024. The learned Advocate for the Petitioners submits that the oral submissions on Exhibit 302, were concluded on 15th June, 2024. The same Judge still continues in the said Court. Hence, it would be advisable to direct the learned District Judge -7 and Additional Sessions Judge, Thane to rehear the parties on Exhibit 302 and then pass an order.

7.

In view of the above, we hope and trust that the learned District Judge-7 and Additional Sessions Judge, Thane will decide the Bail Application, Exhibit 302, in Sessions Case No. 183 of 2022 as 2/3

expeditiously as possible, in any event, within a period of 60 days from today. The concerned Court shall direct the parties to advance their oral submissions, on or before 14th August, 2025.

8.

This Writ Petition is disposed off.
