1) Record indicates that, the Petitioner has already filed a C.R. No. 208 of 2019 dated 20th September 2019, registered with Kapurbawdi Police Station, District Thane, under Sections 417, 420, 423, 467, 468, 471, 474 read with 34 of the IPC. After completion of investigation, the police have filed Final Report under Section 173(2) of the Cr.P.C. in the Court of Judicial Magistrate First Class (Court No.2), Thane.
2) Perusal of First Information Report and the gist of allegations crystalized while filing the charge-sheet indicates that, the same allegations are reiterated in the present complaint. However, the present complaint is filed with different Police Station i.e. Kopari Police Station, Thane. The 1/2
dtg 61-Wp-3137-2025.doc Petitioner has now invoked jurisdiction of this Court under Article 226 of the Constitution of India, on the basis of his complaint dated 4th April 2024, registered with Kopari Police Station District Thane. As noted earlier, the earlier crime baring C.R. No. 208 of 2019, has been registered by the Petitioner for the same cause of action.
3) After hearing the learned Advocate for Petitioner at length, when this Court was not inclined to grant any relief as prayed for, he on instructions seeks leave to withdraw Petition unconditionally. 3.1) Leave granted.
4) Disposed off as withdrawn.
