The Petitioner-in-person submits that in view of the subsequent developments especially the order passed by the Division Bench of this Court in Criminal Writ Petition No. 1096 of 2024 wherein a statement was made on behalf of the prosecution that the investigating agency would seek the closure of the proceedings against co-accused under Section 258 of Code of Criminal Procedure, 1973, and, thereupon, the learned Magistrate has been requested to decide the said application expeditiously, the petition may be rendered infructuous. 3.

The Petitioner-in-person thus seeks liberty to withdraw the varsha

3-wp-3196-2025.doc petition with leave to revive the challenge, in the event the learned Magistrate does not accept the prayer of the investigating agency to drop the proceeding against the co-accused under Section 258 of the Code.

Leave granted with liberty as prayed for.

The Petition stands dismissed as withdrawn with liberty to revive the prayer in this Petition in the event the learned Magistrate does not stop the proceeding under Section 258 of the Code, against the coaccused. 6.

In view of the dismissal of the Petition, the Interim Application also stands disposed.
