On the last occasion the submissions of Mr. Amit Desai, learned Senior Advocate in Writ Petition No. 3205 of 2025, Shri. Ravi Kadam, learned Senior Advocate in Writ Petition No. 3215 of 2025 were heard. WE have also heard Mr. Ponda, learned Senior Advocate appearing for one of the Respondent at length.

We had adjourned the matter for today at the request of Mr. Devadutt Kamat, learned Senior Advocate the Respondent No.3. The matter has thus been substantially heard. Upon hearing the learned Counsel, we have to pass appropriate order on the question of grant of interim relief or otherwise as prayed for by the Petitioners. We must state that till now, the Petitioners have not been summoned by the Economic Offences Wing (EOW). We had heard learned Public Prosecutor on the previous occasion.

We had called upon Mr. Kamat, learned Senior Advocate to proceed with the matter. At this stage, Mr. Kamat invited our attention to the order dated 1st September 2025 passed by the Hon'ble Supreme 2 of
Court in Petition for Special Leave to Appeal (Cri.) No. 12786 of 2025. Considering that the matter has been substantially heard and in the light of the observations of the Hon'ble Supreme Court, we deem it appropriate to direct the EOW not to summon the Petitioners till the appropriate order on grant of interim relief or otherwise is passed. Since the matter is substantially heard, we refrain from passing a reasoned order.

Mr. Kamat, learned Senior Advocate submitted that he is under instructions to challenge this order and hence, insisted that the matter be listed on 17th September 2025.

Mr. Amit Desai and Mr. Ravi Kadam, learned Senior Advocates vehemently opposed the request made by Mr. Kamat and insisted that since the matter has been substantially heard, the request for adjournment be declined. However, as Mr. Kamat, learned Senior Advocate persisted with his request, we are inclined to list the Petitions for further consideration at his request on 17th September 2025 at 4.35 p.m.
