DATE : 02nd JULY, 2025 JUDGMENT (Per : A.S.Gadkari, J.) :- 1) Husband (Petitioner No.1); father-in-law (Petitioner No.2) and mother-in-law (Petitioner No.3) of Respondent No.2, have filed this Petition under Article 226 of the Constitution of India, for quashing of C.C. No. 54/PW/2024, pending on the file of 27th Judicial Magistrate First Class, Mulund, Mumbai, arising out of C.R.No. 0133 of 2023 dated 21st June, 2023, registered with Navghar Police Station, Mulund, Mumbai under Sections 498-A, 406 read with 34 of the Indian Penal Code, with the consent of Respondent No.2, the informant.
2) Learned Advocate appearing for Respondent No.2 tendered across the bar her Affidavit dated 1st July, 2025, duly affirmed before a Notary Public. It is stated therein by Respondent No.2 that, divorce petition 2/3
bearing Petition No. A-1111/2024 is already pending before the Family Court. That, the Petitioner No.1 and Respondent No.2 have executed consent terms dated 25th April, 2025 before the Family Court at Bandra, Mumbai. In Paragraph No.8 thereof, Respondent No.2 has stated that, after a lot of deliberation, she has decided to withdraw the abovesaid FIR and/or case against her husband and in-laws. That, she has 'No Objection' of whatsoever nature, if the FIR and/or case is quashed. 2.1) Respondent No.2 is personally present in Court and through her Advocate, reiterates the contents of her affidavit dated 1st July, 2025 and her 'No Objection' for quashing of crime in question. 3) In view of the above, Petition is allowed in terms of prayer clauses (B) and (C).
