The petitioner is seeking transfer of investigation in F.I.R. no. 1198 of 2023, which was registered with Mahad City Police Station, Taluka Mangaon, District- Raigad on the allegation of commission of the offence under Sections 408, 409, 417, 420, 465, 467, 468, 471, 120-B of the Indian Penal Code.

The petitioner-bank states that the charge-sheet has been laid in this case. While so, the matters at the first instance rest with the jurisdictional Magistrate, who can accept the charge-sheet, reject the charge-sheet or order further investigation under Section 173 of Code of Criminal Procedure, corresponding to Section 193 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023. The petitioner-bank does not state that it has filed its protest petition against the charge-sheet filed by the Crime Branch in F.I.R. No.1198 of 2023. 3.

Writ Petition no.3287 of 2025 is dismissed with liberty to the petitioner-bank to avail of such remedy as may be available at this stage.
