1) It is an admitted fact on record that, in the present crime, the First Information Report was lodged on 17th October 2015 and after completion of investigation, the police have filed charge-sheet on 5th July 2016, before the jurisdictional Magistrate. In last about 10 years, the prosecution has not examined a single witness. Mr. Thatte, learned counsel appearing for the Petitioners submitted that, the plea of the Petitioners have already been recorded by the trial Court and thereafter the trial did not proceed.
2) As the trial of the present case is pending for final adjudication for last about 10 years, we direct the learned Judicial Magistrate First Class 1/2
dtg 41-Wp-3381-2025.doc (17th Court), Borivali, Mumbai, seized of C.C. No. 1467/PW/2016, to expedite the trial of the said case and to conclude it on or before 31 st December 2025.
1.2) The aforestated directions are issued by taking into consideration the fact that, as per the list of witnesses, there are in all five witnesses cited by the prosecution in the present crime, out of which two are panch witnesses and one is Investigating Officer. 2) Petition is partly allowed in the aforesaid terms. 3) All the concerned to act on an authenticated copy of the present Order.
