By the order impugned, the learned Sessions Court has allowed the appeal filed by the respondent No.2 and has set aside the order of the learned Magistrate, by which the defence of respondent No.2 in the proceedings filed by the petitioner under the Provisions of Protection of Women form Domestic Violence Act was struck off.

I have heard the learned counsel for the petitioner/wife, Pramod S.Lakare 1/2

The defence was struck off as affidavit of assets and liabilities was not filed. It appears that respondent No.2 has thereafter filed the affidavit of assets and liabilities. In that view of the matter, I am not inclined to interfere with the impugned order. 4.

The petition is dismissed.
