DATE : 02nd DECEMBER, 2025 P.C:- Petition seeking issuance of writ of habeas corpus for production of the minor child before the Court, can be disposed of in the wake of the amicable arrangement being worked out between the parties, who are personally present in the Court along with the respective counsel.

Since it is informed that the petitioner, the father has already instituted a Custody Petition before the Family Court at Bandra, and where he seek custody of his 12 year old daughter, and till appropriate orders are passed on the Interim

2/2 4 WP-3473-25.odt Application filed in the proceedings, it is agreed that the father shall be entitled to avail access of the daughter on first and third Sunday of every month.

Amongst the two Sundays, on one Sunday, the father shall visit Pune and on the other Sunday, the daughter will come to Mumbai to be in his company. In any case, we make it clear that whenever the father has access, we do not intend to impose any strict timelines; we expect that, for as long as the daughter wishes to remain in the company of the father, he shall enjoy such company.

Needless to state that this arrangement shall continue till the petitioner secure appropriate order from the Family Court at Bandra.

With this direction, Writ Petition stand disposed of. We also clarify that the aforesaid arrangement is without prejudice to the rights and contentions, to be canvassed before the Family Court as well as in any other proceedings and will operate mutually as an interim arrangement.
