The patient had visited the Petitioner's hospital complaining of shoulder pain. He was examined and treated. Thereafter, it is said that he lodged police complaint with the Worli Police Station. The IO is alleged to have visited the Petitioner's residence at around 1:00 a.m. on 24.04.2025 and he was taken out from his residence by the said Respondent No.2 and Police Inspector Mr.Jadhav along with 7 police officials, including of 1/2

When the Petitioner informed the police officials that he had a surgery scheduled at 5:30 a.m. on the same day i.e. 24.04.2025, at Nanawati Hospital, a police official in civil clothes is alleged to have snatched his mobile phone. The Petitioner was granted bail by the Competent Court on 29.04.2025 and he was released from the custody on 30.04.2025. After an inquiry, the Petitioner was found to be a Medial Practitioner with proper Medical certificates and documents.

This Petition has been filed for seeking action under Section 528 of BNSS against this official, who is alleged to have indulged in the aforesaid behavior.

Issue notice to the Respondents, returnable on 11.08.2025. The learned Addl. PP waives service of notice for Respondent Nos.1, 3 and 4. Let affidavit in reply be filed at least one week prior to the returnable date.
