At the outset, Mr. Subhas Jha, learned Counsel appearing for the Respondent No.2 raises the objections to the maintainability of the Petition on the ground that there is an alternate statutory remedy of Appeal under Section 29 of the Protection of Women from Domestic Violence Act, 2005 ('DV Act').

In view of the same Mr. Shukla, learned Counsel Appearing for the Petitioner seeks withdrawal of the Writ Petition. He states that he will file statutory Appeal as available under Section 29 of DV Act.

Accordingly, the Writ Petition is allowed to be withdrawn with leave as sought.

It is clarified that this Court has not considered the merits and all contentions on the merits of both the parties are expressly kept open.
