It is stated at the Bar that cognizance of the offence has been taken by the Court concerned. In that view of the matter, the writ petition shall not be maintainable by the Division Bench of this Court and the petitioner is required to challenge the order taking cognizance before the jurisdictional Court.

Therefore, the learned counsel for the petitioner seeks withdrawal of this Writ Petition with liberty to challenge the order taking cognizance before the appropriate forum. 3.

Criminal Writ Petition No.3534 of 2025 is dismissed as withdrawn with liberty as prayed for by the petitioner. 4.

However, we may indicate that withdrawal of this Criminal Writ Petition by the petitioner is for technical reasons and this should not be construed as reflection by this Court on the merits of the matter.
