The petitioner is seeking a direction to the Additional Divisional Commissioner, Konkan Division, Mumbai to exercise his powers under section 379 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and cause an enquiry against the respondent nos.2, 3 and 4. This prayer has been made on an allegation that these respondents suppressed a vital document and misled the Court concerned to pass an order dated 13th February 2025. 2.

In our opinion, on such allegation the proper remedy for the petitioner shall be to challenge the said order before the appropriate forum. Therefore, without observing anything on the merits of the matter, this writ petition is permitted to be withdrawn on a request made by Mr. Satish Muley, the learned counsel for the petitioner.

Writ Petition no.3568 of 2025 is dismissed. All contentions are left open.
