Heard the learned Counsel for the Petitioner. 2.

The challenge in this petition is to an order dated 3rd April, 2025, passed by the Maintenance Tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

In view of the decision of this Court in the case of Jagdish Pitambar Pawar Vs Pitambar Pundalik Pawar and Ors,1 the Petitioner has a statutory remedy of appeal before the Appellate Tribunal.

The learned Counsel for the Petitioner, thus, seeks leave to withdraw the petition with liberty to file an appeal before the Appellate Tribunal.

Leave granted with liberty as prayed for.

The time spent by the Petitioner in prosecuting this petition may be accounted for under Section 14 of the Limitation Act, in the event the question of limitation, for filing the appeal before the Appellate Tribunal, arises.

It is clarified that, this Court has not entered into the merits of the matter and all contentions of all the parties are kept open to be adjudicated by the Appellate Tribunal in the appeal to be filed by the Petitioner.
