This is a Petition for quashing of the proceedings arising out of C.R.No.I-292/2007 registered with Nallasopara Police Station, Dist. Thane under Sections 498-A, 504, 506 of the Indian Penal Code, 1860. The FIR was registered on 01/09/2007. The charge-sheet is already filed. 2) Heard Adv. Raghava M., learned Counsel for the Petitioners and Ms. Supriya Kak, learned APP for the Respondent No.1 - State. 3) The FIR was lodged by the Respondent No.2. The Petitioner No.1 is her husband. The Petitioner Nos.2 and 3 are her brothers-in-law and the Petitioner No.4 is the sister-in-law of the Respondent No.2. The brief allegations in the FIR are that the Respondent No.2 got married with the Petitioner No.1 on 18/02/2007. She started residing with the Petitioner No.1 at Vasai. The Petitioner No.1's elder sister - Sultana had obtained divorce from her husband and she was also residing with them. She used 1/2
P.H. Jayani 17 WP3760.2025.doc to dominate the Respondent No.2. There was discord between them but the Respondent No.2 was forced to share the household with the said Sultana. That was the bone of contention. There are allegations that because of this dispute, she was ill-treated and threatened. On all these allegations, the FIR is lodged. The charge-sheet contains the statements of parents and the brother of the Respondent No.2. They have supported her case. 4) Now, the parties have arrived at the settlement. Respondent No.2 has filed her Affidavit which is annexed at Exhibit - D of this Petition. She is present in the Court. She has not engaged any Advocate. She insisted on appearing as party-in-person. She informed the Court that the parties have settled the matter and she has no objection for quashing of the present proceedings.
She has stated so in the Affidavit annexed at Exhibit - D and she reiterated the contents of the Affidavit before the Court. 5) Considering the settlement between the parties and taking into account the no objection given by the Respondent No.2, we are inclined to allow this Petition. Hence, the following Order :- (a) The proceedings arising out of C.R.No.I-292/2007 registered with Nallasopara Police Station, Dist. Thane under Sections 498-A, 504, 506 of the Indian Penal Code, 1860, are quashed and set-aside.
