The Petitioner had approached the Competent Court, i.e., the learned 6th Court of Judicial Magistrate First Class at Panvel, Navi Mumbai by invoking Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS, 2023), on 10th July 2023.

The concerned Court noticed that compliance of Section 173(4) of the BNSS, 2023 was not done by the Petitioner. The Petitioner, therefore, tendered a withdrawal purshis, Exhibit 6. The Petitioner has now complied with the said legal requirement by tendering a complaint on 21st 1/2

Trupti 3-wp-3803-2025 April, 2025 to the Deputy Commissioner of Police, Zone II, Navi Mumbai, Panvel. Thereafter, a statement of the Complainant was also recorded on 17th June 2025.

Therefore, the learned Advocate for the Petitioner submits, on instructions, that upon due compliance with Section 173(4) of the BNSS, 2023, the Petitioner intends to approach the same Court to lodge a complaint under Section 175(3), in light of the cause of action that has arisen subsequent to the lodging of the complaint on 21st April, 2025. 4.
