The learned Advocate for the Petitioner submits that the Petitioner desires to withdraw this Petition and approach the Municipal Corporation to find out whether the Tree cutting that has allegedly occurred, was after compliance of the necessary provisions of law. 2.

In view of the above, this Petition is disposed off as withdrawn on instructions.

Before parting with this matter, we need to take cognizance of an unofficial certificate placed on record at page No.28 by the Petitioner. The same is reproduced hereunder:

CERTIFICATE This is to Certify that Mr./Ms.VINOD RAGHUNATH SONKAMBLE R/o. VALMIK NAGAR, NETAJI PALKAR MARG, GHATKOPAR (W) MUMBAI has passed THE R T I COURSE EXAMINATION conducted by MASS-INDIA & LEX SCRIPTA LLP on 9th July 2021. Adv. Suresh Menchirel B.Com., LLB, LLM, MSW (Chief Exam Controller) National President, MASS-INDIA 4.

The learned Advocate for the Petitioner submits on instructions that aforesaid certificate is not issued by any statutory authority or a recognized institution and is actually issued by an NGO. We find that the said certificate does not even have the signature of an authorised person. We, therefore, direct that the Petitioner shall not make use of the certificate any time in future, unless it's authenticity and genuineness is established. 2/3

To ensure that there is no misuse of the said certificate, we direct the learned Registrar of this Court to place this Order before the Bar Council of Maharashtra and Goa (BCMG) for verifying as to whether the name below the said certificate i.e. 'Advocate Suresh Menchirel', is printed with his consent and if yes, whether, he is a practicing Advocate and whether he is permitted to issue such certificates without his signature. The BCMG would issue a notice to Advocate Suresh Menchirel, to seek his response. 6.

In the event the Petitioner approaches the Municipal Corporation, all contentions are kept open, including the aspect of locus-standi of the Petitioner and whether he is espousing a cause in his own interest or in public interest.
