KVM 60 - WP 3882-2025.doc Indian Penal Code has filed this Petition under Article 226 of the Constitution of India, for quashing of the said crime with the consent of Respondent No.2, the informant.
2) Mr.Prabhune, learned Advocate for the Petitioner submitted that, the Petitioner and Respondent No.2 have filed Consent Terms in Civil Writ Petition No. 12742 of 2023 on 9th April, 2025. That, as per the said Consent Terms, Respondent No.2 is giving her consent for quashing of the crime in question. He therefore prays that, the said crime may be quashed with the consent of Respondent No.2.
3) Ms.Maindad, learned Advocate appearing for Respondent No.2 tendered across the Bar, her Affidavit dated 23rd July, 2025, duly affirmed before a Notary Public. The fact of filing of Consent Terms on 9th April, 2025 before this Court is admitted therein. In Para No.(9) thereof, Respondent No.2 has given her 'No Objection' for quashing of the crime in question.
3.1) Respondent No.2 is personally present in the Court and through her Advocate reiterates the contents of her Affidavit dated 23rd July, 2025 and her 'No Objection' for quashing of the crime in question. 4) In view of the above, Petition is allowed in terms of prayer clause (a).
