The learned Advocate for the Petitioner relies upon Lalita Kumari v. Government of Uttar Pradesh and Others and seeks to know what steps have been taken by the Joint Commissioner of Police pursuant to the preliminary report which was submitted to the Joint Commissioner of Police on 5th March, 2025 regarding the complaint lodged by him on 4th July, 2023.

The learned APP submits, on instructions received from Mr.Y.R.Bhadre, API, who is present in the Court, that the said Joint Commissioner of Police, Mr.Nitesh Mishra, is having some health issue and 1/2

Trupti 17-wp-3953-2025 from 5th March, 2025 when the report was submitted to his Office, he had not done anything till today.

The learned Advocate for the Petitioner submits that the Petitioner desires that this Court should pass an order in the light of Lalita Kumari (supra).

In view of the above, we are compelled to observe that the Director General of Police, State of Maharashtra should transfer the file pertaining to the complaint dated 4th July 2023, along with the preliminary enquiry report dated 5th March 2025, to any other officer who has the jurisdiction to deal with the said Complaint. 5.

We are listing this Petition on 4th August, 2025, in the fresh admissions category.

The learned APP will inform the Court about the steps taken by the new officer entrusted with the file.
