P.C.:- 1) Husband of the Respondent No.2, has filed present Petition under Article 226 of the Constitution of India, for quashing of CC No.6900875/PW/2023, pending on the file of 69th JMFC, Mazgaon, Mumbai, arising out of CR No.0537 of 2022 dated 26th June, 2022, registered with Sir J.J. Marg Police Station, Mumbai, under Sections 498(A), 406, 504 and 506 r/w 34 of the Indian Penal Code and Section 4 of Dowry Prohibition Act, 1961, with the consent of Respondent No.2, the informant.

ssm 2 47-wp4054.2025.doc 2) Learned Advocate for the Petitioner submitted that, there were in all six accused persons. That, the original accused Nos.2 to 6 were the close relatives of the Petitioner.
2.1) The Hon'ble Supreme Court by its Order dated 29th April, 2024, in Criminal Appeal No.2309 of 2024, was pleased to quash the crime in question against the original accused Nos.2 to 6 on merits. She produced on record a photocopy of the said Order dated 29th April, 2024. 3) Learned Advocate for the Respondent No.2 submitted that, the Respondent No.2 has already filed on record an Affidavit dated 19th July, 2025, duly affirmed before the Assistant Registrar of this Court. It is stated in paragraph No.7 of the said Affidavit that, the Respondent No.2 has given her free consent and no objection for quashing of the said crime. 3.1) Respondent No.2 is personally present in Court and through her Advocate reiterates the contents of her Affidavit dated 19th July, 2025 and her 'No Objection' for quashing of the crime in question. 4) In view thereof, Petition is allowed in terms of prayer clause (b).
