We have heard the learned Advocate for the Petitioner and the learned APP.

The charge-sheet has already been filed before the trial Court. The learned APP submits that the Petitioner can move an application Exhibit A invoking Section 173(8) of the Criminal Procedure Code. The trial Court can decide the said application. The learned Advocate for the Petitioner points out Mane 1/2
21- WP 4142-25.odt that he has not preferred any application before the Trial Court seeking an order for additional investigation and addition of Sections. He submits that the trial has commenced.

As such, if the Petitioner prefers an application as is permissible in law, the learned Trial Court would consider the same and decide the application on its own merits. The Investigating Officer would ensure that the written say to the application is filed within a period of 30 days from the date of the filing of the application.
