P.C.:- 1) Heard Mr. Topiwala, learned Advocate for the Petitioner. 2) By this Petition filed on 31st July, 2025, the Petitioner is seeking furlough leave for the year 2025. Shri. B.C. Nimgade, Superintendent of Open District Prison, Paithan has filed an Affidavit dated 15th August, 2025. In paragraph No.7 thereof, it is stated that the Petitioner had filed an Application dated 4th February, 2025 for furlough leave which was considered by the Competent Authority and thereafter the Petitioner was granted furlough leave of 28 days by its Order dated 5th March, 2025. Petitioner thereafter was released from jail on furlough leave from 10th March, 2025 to 8th April, 2025. The Petitioner has reported back to the jail Authority within prescribed time.

ssm 46-wp4239.2025.doc 3) As per the Furlough and Parole Rules, the convict is eligible for furlough leave once in a year. As the Petitioner has already availed the benefit of furlough leave for the year 2025, his prayer for furlough leave for the same year cannot be entertained.
4) In view of the above, we find there are no merits in the Petition and is dismissed.
