1) Learned APP on instructions from Mr. Kerurkar, PSI, Lonavala City Police Station, Pune, submitted that, since the date of registration of crime, the Petitioner is absconding. That, the Investigating Agency has already filed charge-sheet in the present crime under Section 299 of the Cr.P.C. The prosecution has already issued proclamation under Section 82 of the Cr.P.C. against the Petitioner.

1.1) As the Petitioner is reported to be absconding, we are not inclined to exercise our discretionary jurisdiction under Article 226 of the Constitution of India, in favour of the Petitioner. 2) Petition is accordingly dismissed in-limine.
