This is stated at the Bar that cognizance of the offence has been taken by the Court concerned.

Mr. Amit Munde, the learned Special Public Prosecutor for the CBI tenders a copy of the order dated 25th September 2025 passed in Criminal Writ Petition No.3077 of 2025 which would indicate that a co-ordinate Bench of this Court permitted co-accused Bhupendra Tejendra Kaushal to withdraw the writ petition with liberty to him to challenge the order taking cognizance.

Since cognizance of the offence has been taken by the Court concerned, this writ petition shall not lie in view of the Rule No.2 (II) (h) under Chapter-I of the the Bombay High Court Appellate Side Rules, 1960.

Therefore, reserving a liberty with the petitioner to challenge the order taking cognizance, Writ Petition No.4434 of 2025 is dismissed as withdrawn.
