IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 4469 OF 2025 ABC } Petitioner versus State of Maharashtra & Anr.

} Respondents Ms. Binita Sharma i/b. Mr. Ajay Khade, Advocates for the Petitioner.

Ms. S. V. Gavand, APP for Respondent No. 1.

CORAM:

SHREE CHANDRASHEKHAR, CJ. & GAUTAM A. ANKHAD, J.

DATE:

14th OCTOBER 2025 P.C.:

Mr. Hemant G. Chandewar, the father of the petitioner and Mr. Dipesh B. Vira, the father of the respondent no. 2 are present in the Court.

2.

Mr. Dipesh B. Vira, the father of the respondent no. 2 states that he is satisfied with the remorse shown by the petitioner while tendering apology to his daughter-respondent no. 2. 3.

As we gather from the materials on record, the complaint made by the respondent no. 2 seems to be an innocuous communication to the police. The petitioner and the respondent no.2 both are school mates studying in the same class in Swami Vivekanand International School and Junior College, Sai Nagar, Kandivali (W), Mumbai. Both are minors and seems not to have any intention to cause hurt to each other. In our opinion, the offence alleged against the petitioner is not made out, inasmuch as, the offending post was just a juvenile prank.

2-WP.4469.2025.doc 4.

In view of the aforesaid, the writ petition is allowed. Consequently, First Information Report No. 563 of 2025 registered on 10th July 2025 at Kandivali (W) Police Station is quashed. [GAUTAM A.
