Earlier the revision filed by them was withdrawn as per order dated 11.03.2025, on page no. 1505. My attention is invited to order dated 23.01.2025 passed in those revisions. Direction was given to seek by SEEMA KSHITIJ YELKAR Date:

9 Wp-4497-2025.doc a report from the Forensic Science Laboratory. The learned APP submitted that report is already received. On this background, this quashing petition is filed.

Learned Advocate Shri Kocharekar tried his level best to convince me that Writ Petition is maintainable. He invited my attention to the charge framed against these Petitioners, on page no. 1511 and charge framed against co-accused on page no. 1516. According to him, charge against his client pertains to use of the inferior materials. Whereas charge against co-accused relates to improper maintenance of toilet. He also invited my attention to the letters sent by Corporation for proper maintenance of the toilet. He also invited my attention to the report given by the Expert Committee. 4.

Be that as it may, these contentions can be raised in the trial only. On this background, he seeks liberty to withdraw this petition. Liberty is granted. Petition is disposed of as withdrawn. [S. M. MODAK, J.] Seema 2/2
