The petition is filed for the issuance of a writ of habeas corpus, praying for the production of 3 year old child who, according to the petitioner, has been taken away by his wife - respondent no.4. Today, the respondent no.4 is personally present in the Court and makes a statement that the child, Rudra, is with her. 2.

The petitioner make a grievance that he has not seen his child for more than two years and though we are not here to determine the issue of lawful custody of the child and parties are at liberty to initiate the proceedings before the appropriate forum, by way of an interim arrangement, we direct that the respondent no.4 shall provide access of the child to the petitioner on 1st and 3rd Saturday of every month from 3.00 p.m. to 5.00 p.m., in the Family Court complex at Pune.

2/2 10 WP 4664-25.doc This arrangement shall continue for a period of six months, and we expect the parties to initiate appropriate proceedings. 3.

Upon this order being passed, the Registrar of the Family Court at Pune shall ensure that the petitioner and respondent no.4, along with their child, are accommodated in the children's area for availing the access for three hours.

Needless to state that, on any of the scheduled dates, if the parents of the petitioner are desirous of meeting the child, they shall be permitted to accompany him.
