The petitioners are aggrieved by registration of the First Information Report vide C.R. No.234 of 2025 at Jaykheda Police Station within the district of Nashik.

2. The offences alleged against the petitioners are under sections 3(5), 108, 115, 351(2), 351(3), 352 of the Bhartiya Nyaya Sanhita, 2023. The learned counsel for the petitioners submits that on a bare reading of the First Information Report it can be easily concluded that the offence of abetment to suicide cannot be alleged against the petitioners. However, Mrs. G.P. Mulekar, the learned Additional Public Prosecutor would contend that at this stage this Writ Petition seeking quashing of First Information Report cannot be entertained for the reason that there has been allegation of commission of other offences under the Bhartiya Nyaya Sanhita, 2023.

some time seeks permission to withdraw this Writ Petition with liberty to the petitioners to approach this Court at an appropriate time, if any need so arises, to avail of legal remedy available to them.

Writ Petition No.4665 of 2025 is disposed of as withdrawn with the aforesaid liberty to the petitioners. We would also indicate that we have not reflected on the merits of the submissions and the legal grounds raised by the petitioners in this Writ Petition and those shall remain open for the petitioners to raise in a proceedings, if any, taken out by them.
