1) Perusal of record of investigation prima facie indicates that, the concerned Investigating Officer has investigated present crime of serious nature, casually rather callously. The allegation that, there were two other persons who were instrumental in abducting the Petitioner and putting him into a white colour car is not investigated. It appears that, no efforts have been taken by the concerned Investigating Officer to investigate the allegations of use of fire arms by the principal accused at the time of his abduction and/or immediately thereafter. There are various other lacunae in the investigation.

2) Before we proceed to pass further comments, we deem it 1/2

dtg 22-Wp-4679-2025.doc appropriate to direct the Joint Commissioner of Police, Navi Mumbai, to file his detailed reply to the Petition. We direct the Joint Commissioner of Police, Navi Mumbai, not to delegate his powers to any subordinate Officer. 2.1) We request to the Joint Commissioner of Police, Navi Mumbai, to peruse the entire record of investigation and place on record why the Investigating Officer did not take any efforts to trace out the other two accused persons and recovery of the alleged fire arms. 2.2) The said reply be filed within a period of three weeks from today.

3) Stand over to 11th December 2025.
