IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO.4728 OF 2025 Avtar Singh Sethi ...

Petitioner versus State of Maharashtra ...

Respondent Ms. Sunaina Chakravarthy, for Petitioner.

Mr. Prasanna Malshe, APP for State.

CORAM: N.J.JAMADAR, J.

DATE :

15 SEPTEMBER 2025 P.C.

1.

Heard the learned Counsel for the Petitioner. 2.

A limited grievance in the Petition is that the proceedings in PW/ 825/2003 are not being conducted expeditiously. 3.

The record indicates that, the prosecution came to be filed and registered in the year 2003. The prosecution is now pending for hearing arguments on the application for discharge since 2016. 4.

The grievance of the Petitioner appears legitimate. From the perusal of the case status, it appears that the application for Discharge is pending for arguments for over 9 years.

5.

In this view of the matter, the Petition stands allowed and the learned Magistrate seized with Case No.PW/825/2003 is requested to hear and decide Discharge Application as expeditiously as possible and preferably within a period of four months from the date of communication of this order SSP 1/2
