Mr. Rajiv Shakdher, the learned senior counsel for the petitioner submits that the arrest of the petitioner on 13th August 2025 was a gross abuse of the powers of arrest and in teeth of the decisions of the Hon'ble Supreme Court in "Arvind Kejriwal v. Directorate of Enforcement" 2024 SCC OnLine SC 1703 and "Pankaj Bansal v. Union of India & Ors." 2023 SCC OnLine SC 1244. 2.
Besides other grounds raised in this writ petition, the learned senior counsel for the petitioner submits that the order of remand dated 14th August 2025 reflects a complete non-application of mind and the said order has been passed in a routine manner. 3.
Liberty to amend the prayer clause in this petition is granted. 4.
Since the issue involved in this case pertains to legality of the arrest of the petitioner on 13th August 2025 and the remand order dated 14th August 2025, we are inclined to grant one weeks' time to the respondent no.1 to file reply-affidavit in this matter. 5.
