IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO.4834 OF 2025 Nitin Rajkumar Bansal ...

Petitioner versus State of Maharashtra and Ors.

...

Respondents Ms. Meenakshi Ravkhande, for Petitioner.

Mr. P.P.Malshe, APP for State.

PSI K.S.Gund, Vimantal Police Station, Pune City, present. CORAM: N.J.JAMADAR, J.

DATE :

19 SEPTEMBER 2025 P.C.

1.

Heard the learned Counsel for the Petitioner. 2.

The challenge in this Petition is to a notice dated 26 August 2025 issued under Section 59 of the Maharashtra Police Act, 1951. 3.

There is no justifiable ground to entertain the Petition as only a notice under Section 59 of the Act, is issued calling upon the Petitioner to show cause as to why action under Section 56(1)(a) and (b) of the Act, be not initiated against the Petitioner.

4.

The Petitioner would have an efficacious opportunity of appearing before the Competent Authority in response to the notice by filing appropriate reply.

5.

A grievance was also made on behalf of the Petitioner that the Competent Authority is not deciding the proceeding expeditiously. SSP 1/2

12 wp 4834 of 2025.doc 6.

The Competent Authority shall pass appropriate orders in pursuance of the notice issued to the Petitioner as expeditiously as possible. 7.
