CORAM : SHREE CHANDRASHEKHAR, CJ. & GAUTAM A. ANKHAD, J.

DATE : 24TH SEPTEMBER 2025.

P.C. :

On a Court's query as to how prayer formulated at clause (a) is maintainable, Mr. Nitin P. Deshpande, the learned counsel for the petitioner states that the said prayer is not happily worded. 2.

At prayer clause (b), the petitioner is seeking a direction to the Investigating Officer to complete the investigation in First Information Reports registered at Kondwa Police Station, Pune being FIR Nos.664/2021, 665/2021 and 881/2021 and First Information Report registered at Yervada Police Station, Pune being FIR No.442/2025. The learned counsel for the petitioner submits that the investigation in these cases is pending since long and delay in completion of the investigation is causing prejudice to the petitioner.

3.

In this Writ Petition, except stating some facts, the petitioner does not even indicate about the previous and pending proceedings taken out in the Courts relating to the same subject matter. We have heard Writ Petition (Stamp) No.19041 of 2025 which discloses that several civil proceedings were taken out by the parties in the Courts. However, in this Writ Petition, nothing has been disclosed regarding such proceedings pending in the Courts or disposed of. This Writ Petition does not even indicate whether the accused-persons in the aforementioned First Information Reports have been granted bail/anticipatory bail or approached the Court for quashing of the proceedings arising out of First Information Reports registered at Kondwa Police Station, Pune being FIR Nos.664/2021, 665/2021 and 881/2021 and First Information Report registered at Yervada Police Station, Pune being FIR No.442/2025.

4.

Notwithstanding such defects in the petition which may amount to suppression of material facts, in view of the judgment of the Hon'ble Supreme Court in "S.P. Chengalvaraya Naidu v. Jagannath" (1994) 1 SCC 1, there is no merit in this Writ Petition and is, accordingly, dismissed.
