IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO.4860 OF 2025 Prashant Haribhai Soni ...

Petitioner versus The State of Maharashtra and Anr.

...

Respondents WITH WRIT PETITION NO.4867 OF 2025 Prashant Haribhai Soni ...

Petitioner versus The State of Maharashtra and Anr.

...

Respondents Ms. Kavya Smriti i/by Mr. Ashok M. Saraogi, for Petitioner. Mrs. Rashmi Tendulkar, APP for State.

CORAM: N.J.JAMADAR, J.

DATE :

6 NOVEMBER 2025 P.C.

1.

Heard the learned Counsel for the Petitioner. 2.

A limited grievance in these petitions is that the revision applications preferred by the Petitioner against the orders passed by the learned Magistrate on the applications for return of property are not being heard and decided by the learned Sessions Judge, expeditiously. 3.

The Court finds that the learned Magistrate passed orders on 6 June 2018 and 7 March 2018, respectively, thereby rejecting the applications for return of property during the pendency of the trial. 4.

It appears that Criminal Revision Application Nos.213 of 2018 and 268 of 2022 are pending before the Sessions Court for quite long time. In these SSP 1/2

62 wp 4860 of 2025.doc circumstances, the Writ Petitions stands disposed, with a request to the learned Sessions Judge, seized with the abovenumbered Revision Applications, to hear and decide the same as expeditiously as possible. 5.

It is hereby made clear that all contentions, including the maintainability of the revision applications against an order passed by the learned Magistrate, are kept open for consideration.
