Heard the learned Counsel for the parties.

This petition is to quash and set aside an order dated 8th May, 2024 passed by the learned Sessions Judge in Misc. Application No.953 of 2023, whereby the application preferred by the petitioner to modify the condition of attendance at Sion Police Station on every Tuesday and Friday between 11 am. to 4 pm. till further orders, came to be rejected.

From the perusal of the record, it becomes evident that, the petitioner was ordered to be released on bail on 29th December, 2023. The learned APP, on instructions of Mr. A. 1/2
10-CRIWP4883-2025.DOC R. Pathan, the Investigating Officer, who is present in Court, informed the Court that, post the said order and completion of investigation, charge-sheet has been filed. 4.
In view of the aforesaid development and at this stage of the proceeding, the condition of attendance at Sion Police Station twice a week appears onerous. It is, therefore, in the interest of justice that the said condition be modified. 5.
Hence, the petition stands allowed.

The condition No.6 in the order dated 29th December, 2023 stands modified as under:
"The petitioner - accused shall henceforth mark his presence at Sion Police Station, Mumbai, on the first Monday of every month between 10 am to 12 noon till the conclusion of trial."
The petition stands disposed.
