This is a Petition for quashing of the proceedings arising out of C.R.No.464/2023 dated 08/09/2023 registered at Versova Police Station, Mumbai under Sections 354-D, 509, 506, 500 of the Indian Penal Code and under Sections 67 and 67(A) of the Information Technology Act, 2000. 2) Heard Mr. Hasnain Kazi, learned Counsel for the Petitioner, Ms. Sangeeta Shinde, learned APP for the Respondent No.1 - State and Mr. Nishant Das, learned Counsel for the Respondent No.2. 3) The FIR is lodged by the Respondent No.2. It is not necessary to refer to the allegations in the FIR in detail because the parties have settled their dispute and the Respondent No.2 has filed her affidavit giving consent for quashing of these proceedings. Briefly stated, the allegations are that, the Respondent No.2 was knowing the Petitioner because their 1/3

mothers were friends. Since 2021, they kept in touch with each other through a social networking site. In March, 2022 the Respondent No.2 came to Mumbai and returned to Noida in September, 2022. Between this period, they were in touch. She has clearly admitted in her FIR that since October, 2022 their friendship was taken to a next level and there was love relationship between them. In November, 2022 she came back to Mumbai but then the Petitioner started becoming possessive. He started abusing her. There are certain instances where the Petitioner had visited her house and had harassed her. He continued calling her from different phone numbers. He kept abusing and threatening her. He used to threaten her that he would make their photographs viral. He started sending obscene messages. In short, he continued harassing her continuously. Therefore, finally the Respondent No.2 lodged the FIR on 08/09/2023. The investigation was carried out. There are statements of her sister, and her sister's husband who had supported her allegations.

4) Now, the matter is completely settled between the parties. The Respondent No.2 has filed her affidavit giving consent for quashing of the present Petition. There is a reference to a Defamation Suit filed by the Respondent No.2 before the High Court at Delhi against the Petitioner. The matter is now settled. They had entered into a settlement agreement. A copy of the same is annexed at Exhibit - C to this Petition. In her affidavit which is annexed at Exhibit - E, the Respondent No.2 has given her clear no 2/3

objection for quashing of the present proceedings. 5) The Respondent No.2 as well as the Petitioner both are present in the Court. Both of them were identified by their respective Counsel. The Respondent No.2 submitted before the Court that she has no objection for quashing of the present proceedings. She does not entertain any apprehension against the Petitioner that he would harass her in future. 6) The learned Counsel for the Petitioner as well as for the Respondent No.1 pointed out that the settlement terms were executed about one year earlier and for the entire year, there was no untoward incident and no instance of harassment. The Petitioner who is present in the Court also submitted that there would not be any trouble from his side.

7) Considering this situation and since both of them are young and their entire life is in front of them, we are inclined to allow this Petition in the interest of justice and in the interest of parties. Hence, the following Order :- (a) The FIR bearing C.R. No.464/2023 registered at Versova Police Station, Mumbai dated 08/09/2023 under Sections 354D, 509, 506, 500 of the Indian Penal Code and Sections 67 and 67(A) of the Information Technology Act, 2000 and the consequent proceedings arising therefrom, are quashed and set-aside.
