This is a Petition for quashing of the FIR bearing C.R. No.479/2024 registered with Kapurbawadi Police Station, Thane, on 15/05/2024, resulting in RCC No.3700/2024 before the Judicial Magistrate First Class, Thane, u/s 498-A, 504, 506 r/w 34 of the Indian Penal Code.

The FIR is lodged by the Respondent No.2. The Petitioner No.1 was her husband. The Petitioner No.2 is his mother and the Petitioner No.3 is sister of the Petitioner No.1. The parties have settled their dispute and the Respondent No.2 has given her no objection for quashing of the proceedings by filing affidavit. Therefore, it is not necessary to refer to the allegations made in the FIR in detail.

Briefly stated, her case is that in November 2022, their families got in touch with each other through a matrimonial website. On 24/12/2023, the marriage took place between the Respondent No.2 and the Petitioner No.1. Her parents had given her ornaments and other valuable articles. The Petitioner No.1 also had given her some ornaments by way of Stridhan. After marriage, she started residing with the Petitioners. But she was not treated properly. The FIR thereafter goes on to mention different reasons for the dispute between the parties. The

3 / 4 Respondent No.2 was ill-treated. The Petitioner No.1 used to scold and insult her. On 02/04/2022, her parents had come to pacify the Petitioners, but even they were humiliated. On 06/04/2024, she was driven out of her matrimonial house at 02.30 a.m. On these allegations, the FIR is lodged. 5.

Now the parties have arrived at a settlement. She had also filed proceedings under the Protection of Women from Domestic Violence Act, 2005. All the disputes are now settled. She has filed her affidavit in this case giving her consent for quashing of the present proceedings. The Respondent No.2 is present in the Court. She is identified by her learned counsel. She has reiterated the contents of the affidavit. She submitted that she has no objection for quashing of these proceedings as the settlement is arrived at to her satisfaction. 6.

Considering this situation, no purpose would be served if the prosecution continues against the Petitioners. Therefore, in the interest of justice and in the interest of the parties, we are inclined to allow this Petition.

Hence, the following order :

O R D E R

(i) The FIR bearing C.R. No.479/2024 registered with Kapurbawadi Police Station, Thane, on 15/05/2024, resulting in RCC No.3700/2024 before the Judicial Magistrate First Class, Thane, is quashed and set aside.

(ii) The Petition is disposed of.
