P.C. :- [ 1) By this Petition under Article 226 of the Constitution of India, the Petitioner is seeking a relief of suspension of Look Out Circular dated 19th June 2025.
2) The Petitioner is Accused No. 13 in case no. DRI/MZU/NS-II/INT-33/ENQ-16/2025 registered by Respondent No.1 at Mumbai. As the Petitioner is not traceable to the said agency which is investigating the said complaint, the afore-noted Look Out Circular is issued against the Petitioner.

3) Mr. Sayed, learned Advocate appearing for the Petitioner submitted that, the Petitioner is presently stationed at Dubai, United Arab Emirates. The Petitioner intends to come to India and to participate in the ongoing enquiry being conducted by the Officers of the Respondent No.1. He tendered across the bar a photocopy of aeroplane tickets issued by Indigo Company. The said tickets indicate that, the Petitioner will board the said aeroplane at about 9:25 p.m. of 7th December 2025 at Dubai International Airport and will reach to Mumbai at about 2:20 a.m. on 8th December 2025. He submitted that, as the Petitioner is intending to come to Mumbai and participate in the enquiry, the said Look Out Circular may be suspended for a reasonable period.
4) Mr. Munde, learned Special Public Prosecutor appearing for Respondent No.1, on instructions submitted that, the concerned Authority will not apprehend/arrest the Petitioner for a period of 3 days from his actual arrival, provided the Petitioner marks his presence to the office of Respondent No.1 after his arrival on 8th December 2025. 4.1) In view of the above, following Order is passed:- (i) The Look Out Circular bearing no. 2025/10642/00004956 dated 19th June 2025, issued against the Petitioner is suspended from 12:00 o'clock in the midnight of 7th and 8th December 2025 until further orders of this Court.

(ii) The Petitioner shall come to India on 8th December 2025 before 10:00 a.m.
(iii) As soon as the Petitioner returns to India, he shall forthwith report his arrival to the Enquiry Officer of the said complaint at its Office mentioned in the Notice dated 18th August 2025 [page 17] and shall not go to any other place before reporting to the concerned Officer.
(iv) Petitioner is given two days time to avail appropriate legal advise, if required.
(v) Petitioner thereafter shall attend the concerned Office of the Respondent No.1 at the address mentioned in Notice dated 18th August 2025 from 12th December 2025 at 10.00 a.m. till 18th December 2025 and as and when required by the concerned Enquiry Officer.
5) Petition is allowed in the aforesaid terms.
6) List the Petition on Board on 11th December 2025, for reporting compliance of the present Order.
